• "Plans": Refers to the Miverse Cruiser (36-month tenure, $225/month or $7,500 upfront) and Miverse Kingpin (60-month tenure, $200/month or $11,000 upfront) subscription plans.

2. Service Description

We provide secure, scalable hardware hosting services through our data centers, optimized for performance, energy efficiency, and reliable uptime. The Services include:

• Dedicated server resources for data center hosting.

• Network configuration, security setup, and ongoing maintenance.

• 99.9% uptime guarantee as per our Service Level Agreement (SLA).

Hosting Plans

1. Miverse Cruiser:

   • Tenure: 36 months

   • Subscription: $225/month or $7,500 upfront

2. Miverse Kingpin:

   • Tenure: 60 months

   • Subscription: $200/month or $11,000 upfront

3. Eligibility

To use our Services, you must:

• Provide accurate and complete information during the signup process.

• Agree to comply with these Terms and all applicable laws.

4. Subscription and Payment

4.1 Payment Terms

• Monthly Subscription: Payments are due monthly on the same day as service activation. Accepted payment methods include credit card, bank transfer, or other methods specified at signup.

• Upfront Payment: Full payment for the plan term ($7,500 for Miverse Cruiser or $11,000 for Miverse Kingpin) must be made before service provisioning begins.

• Late Payments: A $25 late fee may apply for payments received more than 5 days past due. Services may be suspended until the account is current.

• Taxes: All fees exclude applicable taxes, which will be added as required by law.

4.2 Lock-In Commitment

Both plans require a commitment for the full tenure (36 months for Miverse Cruiser, 60 months for Miverse Kingpin). Early termination may incur penalties as outlined in Section 6.

5. Service Provisioning and Setup

• Order Confirmation: Upon subscription, you will receive a confirmation email within 24 hours detailing the plan, payment, and estimated setup timeline.

• Setup Timeline: Service activation typically takes 3–5 business days from payment confirmation. Custom configurations may extend this timeline.

• Access: Upon setup completion, you will receive secure credentials and instructions for managing your hosting environment via email or our client portal.

• Customizations: Additional resources or configurations may incur extra fees, communicated prior to implementation.

6. Cancellation and Refunds

• Lock-In Commitment: Early termination of either plan incurs a penalty of 50% of the remaining subscription balance.

• Upfront Payment Refunds: Upfront payments are non-refundable except in cases of service non-delivery due to our fault (e.g., failure to provision server resources). Refunds, if applicable, will be processed within 30 days.

• Monthly Subscription Cancellations: You may cancel with 30 days’ written notice, but the lock-in commitment requires payment for the full term.

• Setup Delays: If we fail to activate Services within 10 business days due to our error, you may request a full refund of payments made.

7. Client Responsibilities

You agree to:

• Provide accurate configuration details and promptly respond to setup-related requests.

• Use the Services in compliance with applicable laws and regulations.

• Maintain the confidentiality of access credentials and notify us immediately of any unauthorized use.

• Refrain from using the Services for illegal activities, including but not limited to hacking, spamming, or distributing malicious software.

8. Service Level Agreement (SLA)

• We guarantee 99.9% uptime for our data center hosting services, excluding scheduled maintenance (notified at least 48 hours in advance).

• In the event of downtime exceeding the SLA, you may be eligible for service credits, calculated as a prorated portion of your monthly fee, subject to our review.

9. Limitation of Liability

• To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from the use of our Services, including loss of data, profits, or business opportunities.

• Our total liability shall not exceed the amount paid by you for the Services in the preceding 12 months.

10. Intellectual Property

• All software, tools, or configurations provided by us remain our intellectual property or that of our licensors.

• You retain ownership of any data or content you upload to the hosting environment, subject to compliance with these Terms.

11. Termination
